<p>The register would meet a key call from unions, backed by the 
nanotechnology industry’s previous peak body, for accurate information 
for workers and employers regarding the use of manufactured 
nanoparticles in the workplace. France and the Netherlands have 
committed to mandatory notification and registration for commercial use 
of manufactured nanomaterial</p>
<p>
		“Despite urgent calls from unions, backed by industry groups, there is
 still no mandatory disclosure of nanoparticles used in workplaces, and 
no mandatory register of companies using manufactured nanoparticles," 
Greens Senate candidate for NSW Lee Rhiannon said.</p>
<p>
		“Without this basic information, Australian regulators, workers and employers are flying blind.</p>
<p>
		“If Australia is serious about avoiding a repeat of the asbestos 
tragedy, we must ensure appropriate oversight of this emerging field, 
and the new health risks it poses.</p>
<p>
		“This register will give regulators, workers and employers the 
information they need to make informed decisions about occupational 
exposure and risk management.</p>
<p>
		“Importantly, a national mandatory register of manufactured 
nanoparticles, which is publicly accessible, will also build public 
confidence in federal government oversight of this powerful new 
technology.</p>
<p>
		“Nanotechnology, the ‘science of the small’, is attracting growing attention from industries world-wide.</p>
<p>
		“Hundreds of Australian products now contain nano-ingredients, 
including cosmetics, paints, textiles, building equipment, cleaning 
products, industrial catalysts and more.</p>
<p>
		“Senior scientists have warned that some nanoparticles pose serious 
new health and safety risks. There is evidence that some nanoparticles –
 carbon nanotubes – can cause asbestos-like disease.</p>
<p>
		“The Greens are committed to socially and environmentally responsible 
innovation. We understand that we need to learn from the lessons of the 
past, and Australia’s woeful track record on asbestos.</p>
<p>
		“Today, we commit to put the health of people and the environment first in management of the technologies of the future.”</p>

    <description>Responding to today's report that Ramsay Health Care sacked a worker who had previously been treated for depression in one of their clinics, Greens MP and health spokesperson Lee Rhiannon has called on the company to drop their discriminatory practices and reinstate the sacked worker.</description>

Mr Alistair Colgrave was employed as a casual nurse at Northside Clinic owned by Ramsay. At the end of his first day he was dismissed. The only reason the company gave for his sacking was that Mr Colgrave had been a patient at the clinic for his bi-polar condition. He has not been offered work in another facility run by Ramsay. Mr Colgrave only sought work with Ramsay when his condition stabilised. He was never asked by Ramsay to disclose his medical condition.<br />
<br />
"Ramsay Health Care's motto 'People caring for people' grates when you hear how Mr Colgrave has been treated,” Ms Rhiannon said.<br />
<br />
“Health Minister Carmel Tebbutt should act on this matter. The Minister could assist by making representations to Ramsay Health Care for Alistair Colgrave to be reinstated and to work with the company to assist them to change their discriminatory practices.<br />
<br />
"Ramsay's actions smack of the bad old days where the stigma of a mental health condition served to dog a person's working life.<br />
<br />
"There are many in our society who would be in the same situation. Ramsay should review its policies to ensure this kind of blatant discrimination is not repeated.<br />
<br />
“I spoke to senior management people in Ramsay about Mr Colgrave's sacking and was concerned that they tried to justify their decision.<br />
<br />
“Not only has Ramsay shown no compassion to Mr Colgrave I believe they have broken the law. This is a clear case of unfair dismissal.<br />
<br />
“Ramsay should acknowledge that what they did is wrong and immediately reinstate Mr Colgrave.<br />
<br />
"There are many in our society who would be in the same situation. Ramsay should review its policies to ensure this kind of blatant discrimination is not repeated,” Ms Rhiannon said.<br />

<p><br /><img class="image-right" src="2010leeabccrally.jpg/image_preview" alt="ABCC rally" />The ABCC, which has been likened to a secret police targeting construction workers, can send a worker to gaol for attending a<br />workplace safety meeting.</p>
<p>This is what happened to Ark who has had the courage to publicly expose what the Commission is doing to him.<br /><br /><a class="external-link" href="http://arkstribe.blogspot.com/">Ark's stand</a> is incredibly important, as he has outed the Commission's cohesive powers that mean those interrogated cannot pick their legal team or discuss the secret investigations they are subjected to.<br /><br />I met Ark at the <a class="external-link" href="http://www.mua.org.au/events/may-day-2010/">Sydney May Day</a> rally and he is doing a great job travelling around the country building support for the abolition of<br />the ABCC.<br /><br /><img class="image-right" src="2010abccrally.jpg/image_preview" alt="abcc rally" />The rallies being held around the country are an embarrassing reminder of the Labor government's failure to toss out the ABCC, a leftover of the Howard government years.</p>
<p>It was set up with the clear intent of targeting the <a class="external-link" href="http://cfmeu.asn.au/news/ark-tribe-court-case-update">CFMEU</a> and driving down wages and conditions for construction workers. And who does that benefit, some of the biggest corporations in town.<br /><br />Senator <a class="external-link" href="http://greensmps.org.au/content/media-release/greens-renew-calls-abolition-abcc">Rachel Siewert</a> moved in the federal parliament to abolish the ABCC. Labor and the Coalition voted to defeat the Greens bill.<br /><br />Labor should commit now that after the coming federal election when the Greens and Labor should have the numbers in the Senate that they will immediately move to abolish the ABCC.</p>

<p>In the NSW Upper House tomorrow Ms Rhiannon will bring on a motion that indicates support for the equal case initiated by the Australian Services Union (full motion below).<br />

"Equal pay should be the norm and NSW MPs can show their support for this significant case by backing the Greens motion on equal pay," Ms Rhiannon said.<br />
<br />
"With women in Australian earning on average 18 per cent less than men time for action is long overdue.<br />
<br />
"It is of grave concern that the discrepancy between the pay of women and men is so wide.<br />
<br />
"The fact that women on average have to work two months more a year than men to earn the same amount is disgraceful<br />
<br />
"The Greens strongly support the campaign for equal pay. The Australian Services Union are doing a great job and tomorrow's rally backing the equal pay case deserves support," Ms Rhiannon said.<br />

Equal Pay Motion - Ms Rhiannon to move:<br />

This house notes that:<br />
a) In 2009, the gap in average weekly earnings between men and women rose.<br />
b) Women in Australia earn, on average, 18 percent less than men.<br />
c) On average women have to work 66 days more a year just to earn the same income as men.<br />
d) Feminised work has historically been undervalued and underpaid.<br />
e) Equal pay is a social issue that affects us all.<br />
f) An Equal Pay Case, brought by unions led by the Australian Services Union (ASU), is waiting to be heard by Fair Work Australia.<br />
g) This case has been lodged on behalf of Australia's 200,000 community and disability workers and seeks to establish that the essential work of the community and disability sector carework has been traditionally seen as women's work.<br />
h) Should this case be successful community workers will be awarded pay increases in the realm of 30 per cent.<br />
i) Nationwide rallies will be held on Thursday, June 10, 2010 in support of the ASU's Equal Pay Case.<br />

j) Supports the equal pay case brought by the ASU to Fair Work<br />
Australia on behalf of community and disability sector careworkers, and recognises that this case is needed to address pay discrepancies.<br />

<p>"More stringent regulation of building sites is needed and this issue warrants the attention and support of the Premier," Ms Rhiannon said.<br /><br />"There have been at least two serious building site accidents this year in Sydney, and last year a 12 storey scaffold collapsed in the CBD, trapping a worker and injuring three pedestrians.</p>
<p>"These incidents serve as a wake up call to the NSW government to stand up to Deputy Prime Minister Julia Gillard's Work Health and Safety proposal that, if introduced, would downgrade job safety in NSW.</p>
<p>"The ACTU has criticised the Gillard plan and it is time the Keneally government publicly backed the peak union body on this issue.</p>
<p>"Premier Keneally should be working closely with unions in the coming months to establish strong worksite safety measures. With the prospect of a NSW Coalition government being elected in 2011 this should be a priority for Labor.</p>
<p>"Right now unions and their peak bodies have been sidelined in this rush by the federal and state Labor governments to sign off on their harmonisation plan.</p>
<p>"This is the Premier's opportunity to provide national leadership<br />in the face of Minister Gillard's watering down plans.</p>
<p>"The Greens are not against attempts to bring consistency to the many occupational health and safety laws and regulations across the different states and territories, but the aim always has to be to raise standards, not to leave workers worse off.</p>
<p>"Existing occupational health and safety laws have come about through the struggle and sacrifice of working people over many decades.</p>

push for transport manufacturing contracts to go to China.<br />
<br />
"This is a crude attempt by the Treasurer to make his budget look better
 by using cheaper overseas labour.<br />

"Mr Roozendaal and his department need to work with the manufacturing 
union on retaining and growing skilled jobs in the Hunter and other 
regional areas.<br />
<br />
"The issue of sending NSW jobs overseas will be a test for the Premier. 
She should overrule Mr Roozendaal on his irresponsible plan that mirrors
 former treasurer Michael Costa's favoured option of buying trains 
direct from China.<br />
<br />
"The Treasurer's plan would be a blow to the Hunter, a traditional 
manufacturing area.<br />
<br />
"A report from the Australian Manufacturing Workers Union estimates that
 if the government pushes ahead with its China-made plan for NSW trains 
and buses 2,550 direct and indirect jobs will be lost.<br />
<br />
"Today the Premier should advise Mr Roozendaal to get a copy of the 
AMWU's Build Them Here report that proposes a $4 billion plan that would
 create thousands of jobs over the next decade in manufacturing ferries,
 rail cars and buses in NSW," said Ms Rhiannon.<br />

<p>"Premier Keneally needs to open up talks with Boeing management about how to ensure these jobs stay in Sydney.</p>
<p>"South West Sydney already suffers high levels of unemployment and social disadvantage from poor housing and transport options. This is another body blow to the area.</p>
<p>"The aviation industry brings skills, jobs and an economic boost to NSW and the government must not let it wither on the vine.</p>
<p>"The Premier's recent attempt to talk up NSW as a defence industry hub will look lame if she allows these 350 jobs to go to Victoria.</p>
<p>"The government must see through the spin of Boeing that Milperra workers will be able to take up positions at the relocated Melbourne site.</p>
<p>"Asking workers and their families to move states is untenable and belies the reality of their day to day lives.</p>
<p>"Boeing's decision will impact adversely on workers and their families and see a negative ripple effect on the NSW economy," Ms Rhiannon said.</p>

<p>('<a class="external-link" href="http://www.smh.com.au/national/union-takes-on-labor-over-cheap-foreign-workers-20100211-nv7b.html">Union takes on Labor over foreigners</a>,' page 1 SMH, February 12, 2010 )<br /><br />"The Rudd Government's passion for free trade at all cost is resulting in the 457 visa scheme for temporary foreign workers undermining local working conditions and leaving overseas workers more vulnerable to threats of deportation," Ms Rhiannon said.<br /><br />"The Greens congratulate the CFMEU for its exposure of Federal Labor's failure to reform the 457 visa scheme which Howard modified in 2001 by dropping the requirement for labor market testing.<br /><br />"Last year Prime Minister Rudd used a 7,000 word essay to attack neo-liberalism. But the real story is that free trade agreements are the back-bone of neo-liberalism and Federal Labor's passion for them is hurting local workers.<br /><br />"Unions and the Greens supported this scheme when it required employers to give preference to Australian workers before bringing in overseas workers.<br /><br />"The removal of the labor market testing requirement has serious implications for Australia's labour conditions.<br /><br />"The 457 visa scheme should have been carefully directed to industries and services where there was a genuine skills shortage. Too often the scheme is abused by unscrupulous employers after a quick profit.<br /><br />"The current scheme, which abandons labour market testing, legitimises many of the appalling practices that some companies have used to exploit overseas workers and avoid employing locals.<br /><br />"The 457 scheme hurts both Australian workers and developing economies.&nbsp; By setting the bar so low, overseas countries, often developing countries, lose their precious skilled labour and young workers in Australia lose their chance for skills development.<br /><br />"One of the banes of scheme is it ties vulnerable overseas workers to a single employer.&nbsp; If they lose their job they often lose their right to stay in the country.&nbsp; This leaves overseas workers open to abuse and often unwilling to stand up for rights local workers insist on.<br /><br />"With employers no longer having to test the labour market before bringing in overseas workers, the 457 visa scheme has become a substitute for local skills development.<br /><br />"It is time the federal government reintroduced labour market testing, mandatory payment of market rates and employment of 457 visa workers on collective agreements," Ms Rhiannon said.<br /><br />For more information:&nbsp; Lee Rhiannon 9230 3551, 0427 861 568.</p>
