Partial Win for the Community on Rose Bay Marina development
Tuesday 18 August 2009
Following the Land and Environment Court judgement handed down today giving conditional consent for the Rose Bay and Point Piper marinas, Greens MP and ports and waterways spokesperson Lee Rhiannon has congratulated the community for its spirited fight against the marina expansion, and has blamed the Ports Minister Joe Tripodi for ever letting the proposed development see the light of day.
"I congratulate the community for standing up to this greedy attempt to strip away public amenity at Rose Bay and Point Piper for a private marina," said Ms Rhiannon.
“Had NSW Maritime showed any sense of public service, they would never have granted landholder's consent to the project, and the community and Woollahra Council would never have had to oppose the development in court.
“The Greens will keep fighting to preserve public access to Sydney’s beautiful foreshore lands and waterways”, said Ms Rhiannon.
Local Greens councillors who campaigned against the marina expansion were keen to recognise the partial success of the community's campaign.
“This is a partial win for the united community effort to keep Rose Bay open for public use. The community did not support developer Addenbrook’s attempts to commandeer a public asset for commercial purposes”, said Greens Woollahra Councillor Nicola Grieve.
“Minister for Ports and Waterways, Joe Tripodi should have refused landholders’ consent from the outset. The government body that is entrusted with the guardianship of this public asset is the very same body that is throwing good planning principles out the window for the benefit of a select few," said Ms Grieve.
Greens Woollahra councillor, Susan Jarnason said, “The Sydney Harbour Regional Environmental Plan supposedly protects the harbour. Development should enhance public amenity, not commercialise our waterways”, said Ms Jarnason.
Justice Biscoe of the Land and Environment Court laid down conditions such as:
· Removing the contentious proposed eastern arm of Rose Bay Marina;
· Reduced the number of large boats that can be moored;
· Imposed height restrictions of 7m on 30m boats thus lessening visual impact;
· And a 6m height restriction on the remaining boats.
